TERMS OF SALE

INTRODUCTION:

These general terms of sale apply to all orders made on the website OrientalDesign.com.

When you confirm an order, you accept fully all these terms of sale. OrientalDesign.com can adapt or modify these terms of sale at any time but will apply those in vigor when the order was made.

ORDERS:

We stock all our products in our warehouses. All In-Stock items usually leave our warehouse the business day that follows the date of order and sometimes the same day. Products offer is valid while stocks last in the countries we deliver to: Switzerland, France, England, Spain, and Benelux.

The photos presented on the website are not contractual. Some differences can be noticed but don’t affect the quality of the product while they don’t concern the main characteristics. The colors you see on the website and the real ones can be a bit different. OrientalDesign.com is not responsible for inaccuracies of the photographs on the website.

You might notice some differences between the products delivered and those presented on the website. Our products are all handcrafted, made one by one by artisan so each product is unique and differences can be noticed between two pieces. Orders cannot be cancelled and shipments cannot be refused due to such differences.

The date of the validation of the order corresponds to the date of order when you pay by card and the date of reception of the check or money order when this way is chosen.

OrientalDesign.com can cancel an order when we judge that the behavior of the buyer or the coordinates is doubtful.

PRICE AND PAYMENT:

For European Community buyers, prices are indicated in Euros with no VAT added. For Swiss buyers, prices are indicated in Swiss Francs and 7% ICHA will be added. Buyers can pay by Visa and Master Card or by check.

If you choose to pay by check, we must receive your check within 5 banking days after time of purchase otherwise your order will be cancelled. Your order will be shipped after your check clears.

OrientalDesign.com can change the prices indicated at any moment but will apply those indicated at the time of your order.

The data of your credit card are encrypted with a secure protocol (Datatrans Switzerland) and never clearly pass in transit in the internet.

The payment is immediately done in the bank and OrientalDesign.com or INVESTIA S.A doesn’t have any access of any kind to the data of the card. We certify that your credit card is not registered anywhere, and for that reason, you will have to input that information for each purchase. 

DELIVERY:

We stock all our products in our warehouses. Few minutes after you place your order, we get to work. All In-Stock items usually leave our warehouse the business day that follows the date of the order and sometimes the same day unless otherwise specified. Delivery to your door can take 5 to 15 days and sometimes 1 month thereafter depending on your location.

Delivery to Switzerland:

-       30.00 Swiss Francs shipping cost for items weighing less than 30kg and can be shipped by “La Poste”.

-       80.00 Swiss Francs shipping cost for items over 30kg. They will be shipped by a shipping company.

This cost is reflected in your “Shopping Cart”.

Delivery to France, Spain, England, Germany and Benelux:

-      49.00 Euros shipping cost for small items weighing less than 30kg and can be shipped by “La Poste”.

-     129.00 Euros shipping cost for items over 30kg. They will be shipped by a shipping company.

This cost is reflected in your “Shopping Cart.

For all other countries please contact us by e-mail or phone.

Special attention is needed for products shipped by freight. It is important for you to inspect your shipment carefully! Any damage made to the carton or product itself, must be noted on the freight bill BEFORE the driver leaves. You can either accept the cartons as damaged or you can refuse them. If you do not note damage on the freight bill, the freight carrier may only accept partial responsibility for the merchandise. You must understand that it is your responsibility to inspect all goods before signing that there is nothing wrong.

RETURNS:

If you are unhappy with your purchase you may return the item(s) for a refund or exchange within 7 days of your receipt. The item(s) must be in new condition, unused and in original packaging material.

All items returned under this policy are eligible for a refund. The full purchase price minus OUR ACTUAL shipping and handling a 15% restocking fee will be credited to the same form of payment used in the original purchase. Return shipping costs are the responsibility of the customer (unless the merchandise is defective, damaged in transit, or a result of our error). Therefore customers should insure all returns for the purchase price of the product to protect you in the event of loss or damage.

WEBSITE:

All content on the OrientalDesign.com website: logos, registered trademarks, text, photographs, images, drawings, models or charts, is protected by international copyright laws. None of the content may be downloaded, copied, reproduced, republished, posted, transmitted, stored, sold or distributed without the prior written permission of the copyright holder.

Users agree that all access and use of this Website OrientalDesign.com and its content is at their own risk.

OrientalDesign.com shall not be held liable in any manner for failures, errors, or computer viruses affecting access to this Website, or any computer malfunctions that occur following Website access. OrientalDesign.com shall not be liable in any manner for any direct, incidental, special, consequential, indirect or punitive damages arising out of access to the Website or downloading content including images, text, or video files.

By express agreement between OrientalDesign.com and you, electronic mail messages shall constitute proof between the parties, as well as automatic recording systems used on the Website, specifically as to the nature and date of the order.

APPLICABLE LAW / JURISDICTION:

All other terms and conditions shall be governed by Swiss law.
